Terms of Service

These Terms of Service ("Terms") govern your use of the DiscogMix Chrome extension and the discogmix.com website (collectively, the "Service"), operated by DiscogMix ("we", "us", or "our"). By installing the extension or using the website, you agree to be bound by these Terms. If you do not agree, please do not use the Service.

1. Service Description

DiscogMix is a Chrome browser extension that enhances the Spotify Web Player by allowing users to select multiple artists and shuffle their combined discographies. The Service operates entirely within your browser and interacts with the Spotify Web Player at open.spotify.com.

2. Relationship with Spotify

DiscogMix is an independent product and is not affiliated with, endorsed by, sponsored by, or in any way officially connected to Spotify AB or any of its subsidiaries or affiliates. "Spotify" is a registered trademark of Spotify AB.

The extension requires an active Spotify account and a Spotify Premium subscription for full playback functionality. Your use of Spotify is governed by Spotify's own Terms of Service.

3. Free and Pro Tiers

DiscogMix is available in three tiers:

  • Free tier: Provides core shuffle functionality with up to 5 artists per mix and up to 3 mixes per day. No account or payment required.
  • Pro tier: Unlocks extended features including up to 20 artists per mix, weighted shuffle, all filters, unlimited saved mixes, and future Pro-only features. Available as a monthly or annual subscription.
  • Lifetime tier: Includes all Pro features with a one-time payment and no recurring charges. Access is granted for the lifetime of the product.

4. Subscriptions and Payments

Pro subscriptions and Lifetime purchases are processed through our payment partner, Lemon Squeezy. By purchasing DiscogMix Pro or Lifetime, you agree to the following:

  • Billing cycle: Subscriptions are billed on a recurring basis (monthly or annually, depending on the plan you select) until cancelled.
  • Automatic renewal: Your subscription will automatically renew at the end of each billing period unless you cancel before the renewal date.
  • Price changes: We reserve the right to change subscription pricing. Existing subscribers will be notified at least 30 days in advance of any price increase, and the new price will apply at the next renewal.
  • License key delivery: Upon successful payment, a license key will be sent to the email address you provide. You are responsible for keeping this key secure.
  • Lifetime purchases: Lifetime tier is a one-time payment granting access to all Pro features for the lifetime of the product. "Lifetime" refers to the operational life of the DiscogMix product, not the lifetime of the purchaser. No recurring charges apply.

5. Refund Policy

We offer a 14-day money-back guarantee from the date of purchase. If you are not satisfied with DiscogMix Pro for any reason, you may request a full refund within 14 days of your initial purchase by contacting us at [email protected] or through the Lemon Squeezy customer portal.

After the 14-day period, refunds are provided at our sole discretion. Refund requests for subscription renewals may be considered on a case-by-case basis if submitted within 48 hours of the renewal charge. The 14-day guarantee applies equally to Lifetime purchases.

6. Acceptable Use

You agree not to:

  • Reverse-engineer, decompile, disassemble, or attempt to derive the source code of the extension, except as permitted by applicable law.
  • Share, distribute, sublicense, or transfer your Pro license key to others.
  • Use the Service in any way that violates Spotify's Terms of Service or any applicable laws or regulations.
  • Use the Service to circumvent any access controls, digital rights management, or content protection mechanisms.
  • Use automated tools, bots, or scripts to interact with the Service in a manner that places unreasonable load on Spotify's infrastructure.
  • Modify, adapt, or create derivative works based on the extension or any part of the Service without our express written consent.

7. Intellectual Property

The DiscogMix extension, website, branding, and all associated content are the intellectual property of DiscogMix and are protected by applicable copyright and trademark laws. You are granted a limited, non-exclusive, non-transferable, revocable license to use the Service in accordance with these Terms.

8. Service Availability and "As-Is" Provision

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not guarantee that:

  • The Service will be available at all times or operate without interruption or errors.
  • The Service will remain compatible with future versions of Chrome, the Spotify Web Player, or the Spotify API.
  • Spotify will not change their platform in a way that limits or prevents the extension from functioning.

We will make reasonable efforts to maintain compatibility and functionality, but cannot guarantee uninterrupted service due to factors outside our control.

9. Limitation of Liability

To the maximum extent permitted by applicable law, DiscogMix and its creators, contributors, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

  • Loss of data, profits, or revenue.
  • Interruption of your Spotify service or account.
  • Any action taken by Spotify against your account related to your use of third-party extensions.
  • Damages arising from unauthorized access to your data due to factors outside our control.

In no event shall our total liability to you for all claims arising from or related to the Service exceed the amount you have paid to us in the twelve (12) months preceding the claim, or $50 USD, whichever is greater.

10. Termination

You may stop using the Service at any time by uninstalling the extension and cancelling your Pro subscription (if applicable) through the Lemon Squeezy customer portal.

We reserve the right to suspend or terminate your access to the Service, including revoking your Pro license key, if we reasonably believe you have violated these Terms. In such cases, no refund will be provided.

11. Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will update the "Last updated" date at the top of this page and may notify you through the extension or via email if you are a Pro subscriber.

Your continued use of the Service after changes become effective constitutes your acceptance of the revised Terms. If you do not agree to the updated Terms, you should discontinue use of the Service.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to conflict of law principles. Any disputes arising from these Terms or the Service shall be resolved through good-faith negotiation first, and if necessary, through binding arbitration in accordance with applicable rules.

13. Severability

If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
